Trios Nevada Consumer Health Data Notice

This Nevada Consumer Health Data Notice (“Nevada Notice”) supplements the Trios Privacy Policy and the Trios Consumer Health Data Privacy Policy.

It describes Trios LLC’s practices concerning consumer health data for Nevada consumers to the extent Nevada consumer health privacy law applies.

1. Scope

This Nevada Notice applies to consumer health data processed through the Trios website, mobile applications, any web-based Trios application made available by Trios, Caregiver Weekly, free and paid features, Care Records, caregiver wellness features, Care Circle features, and related Trios services.

Trios accounts may only be created and maintained by individuals who are 18 years of age or older.

Individuals under 18 may not create or maintain a Trios account. An adult account holder may use Trios to organize care for a child or other dependent where the adult is authorized to do so.

2. Categories of Consumer Health Data We May Collect

Depending on the features a user chooses to use, Trios may process consumer health data including:

  • medication names and medication history;
  • medication-related notes or refill information;
  • symptoms;
  • pain information;
  • sleep information;
  • physical or behavioral observations;
  • mood, stress, and energy information;
  • caregiver-wellness information;
  • self-care information;
  • Daily Care Journal entries;
  • Care Records containing health-related information;
  • caregiving needs;
  • health conditions voluntarily entered by a user;
  • disability-related information;
  • cognitive or memory-related information;
  • health-related appointments and schedules;
  • Care Tasks that reveal health information;
  • support scores or wellness summaries;
  • derived or inferred information generated from health or wellness information a user provides.

3. How We Use Consumer Health Data

Trios may use consumer health data to:

  • provide features requested by users;
  • maintain Care Records;
  • maintain care-recipient profiles;
  • organize medications and medication history;
  • organize appointments and care schedules;
  • provide Daily Care Journal functionality;
  • provide caregiver-wellness check-ins;
  • generate wellness summaries or support scores;
  • provide suggested self-care or organizational next steps;
  • display information entered by users;
  • enable Care Circle functionality;
  • support user-directed reports, exports, or sharing;
  • authenticate users;
  • secure the Services;
  • troubleshoot or maintain Trios;
  • prevent misuse or unauthorized access;
  • comply with applicable legal obligations.

Trios limits its use of identifiable consumer health data to the purposes disclosed in this Notice, purposes necessary to provide a product or service requested by the consumer, or other purposes for which legally required consent or authorization has been obtained.

Trios may use aggregated or deidentified information that is not reasonably linkable to an identified or identifiable individual to understand product usage, evaluate functionality, or improve the Services where permitted by law. Trios will not use identifiable consumer health data for materially additional product-improvement purposes not disclosed in this Notice without first providing any additional notice and obtaining any consent required by applicable law.

Trios does not currently use private consumer health data for behavioral advertising.

Trios does not currently sell consumer health data.

4. Sources of Consumer Health Data

Trios may obtain consumer health data from:

  • the account holder, when the user enters information directly;
  • a caregiver, when the caregiver enters information concerning someone receiving care;
  • authorized Care Circle participants, where they are permitted to contribute information;
  • information generated from data provided by users, such as support scores, wellness summaries, or trends;
  • user-directed imports or integrations, if such features are offered and the user chooses to use them.

Trios does not currently purchase consumer health data from data brokers.

Trios does not currently obtain private consumer health data from advertising networks.

5. Categories of Consumer Health Data We May Share

Where necessary to provide a requested service, at a user’s direction, with legally required consent or authorization, or as otherwise permitted by law, Trios may share:

  • medication information;
  • symptoms and health observations;
  • care-recipient health and caregiving information;
  • Daily Care Journal information;
  • Care Records;
  • appointments or schedules revealing health information;
  • caregiver-wellness information;
  • health-related Care Tasks;
  • wellness summaries or related support information.

Where applicable law requires separate consent for sharing, that consent will be separate from consent to collect.

Acceptance of the Trios Terms of Use does not itself constitute consent to collect, use, or share consumer health data where applicable law requires separate affirmative consent or authorization.

6. Categories of Third Parties and Affiliates

Consumer health data may be processed by or shared with the following categories of recipients, but only as permitted by applicable law and consistent with the purposes described in this Notice.

Service Providers and Processors

Supabase

Trios uses Supabase for authentication, database, backend, and related application infrastructure.

Vercel

Trios uses Vercel for website and web-application hosting, delivery, and related infrastructure.

Google Workspace

Trios uses Google Workspace for business communications. Users should avoid placing unnecessary consumer health data in support or privacy emails.

Trios may also use other service providers for security, infrastructure, maintenance, monitoring, and technical operations where reasonably necessary to operate the Services.

User-Selected Recipients

At a user’s direction, consumer health data may be shared with Care Circle participants, family members, caregivers, professionals, or other recipients selected by the user.

Legal Recipients

Trios may disclose information when required or permitted by applicable law or valid legal process.

Business Transactions

If Trios is involved in a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar corporate transaction, information may be transferred as part of that transaction only to the extent permitted by applicable law. To the extent such a transaction involves consumer health data, Trios will handle that information in accordance with applicable consumer health data laws, the Trios Consumer Health Data Privacy Policy, and this Nevada Notice.

Affiliates

Trios currently does not have separately operated affiliates with whom it routinely shares consumer health data.

7. How Consumer Health Data Is Processed

Trios may process consumer health data by:

  • collecting information entered by users;
  • storing information in application databases;
  • organizing information into Care Records or care profiles;
  • retrieving and displaying information to authorized users;
  • updating or correcting information;
  • creating summaries or support scores;
  • transmitting information through user-directed sharing features;
  • securing and backing up application data;
  • deleting information when requested or when no longer reasonably necessary;
  • using authorized service providers to perform infrastructure or processing functions on Trios’s behalf.

8. Reviewing and Correcting Consumer Health Data

Where available, users may review or modify information directly through Trios account features.

If information cannot be corrected through an available Trios feature, a Nevada consumer may request review or correction by emailing:

Emailing privacy@trios-studio.com initiates the request. Please identify the information you believe should be reviewed or corrected without including unnecessary sensitive details in the initial email.

Trios may direct you to an authenticated or otherwise secure process to verify your identity, your Trios account, your relationship to the information, or your authority to act for another person, where applicable.

9. Nevada Consumer Health Data Rights

Subject to applicable law, Nevada consumers may request that Trios:

  • confirm whether Trios is collecting, sharing, or selling consumer health data relating to them;
  • provide a list of third parties with whom Trios has shared or to whom Trios has sold consumer health data relating to them;
  • cease collecting consumer health data relating to them;
  • cease sharing consumer health data relating to them;
  • cease selling consumer health data relating to them;
  • delete consumer health data concerning them.

10. How to Submit a Nevada Consumer Health Data Request

Requests may be initiated by emailing:

Emailing privacy@trios-studio.com initiates the request. Please do not send consumer health data itself or other unnecessary sensitive information in your initial email.

Trios may direct you to an authenticated or otherwise secure process appropriate to the request. We may ask for information reasonably necessary to authenticate your identity, your Trios account, your relationship to the requested information, or your authority to act on behalf of another person, where applicable.

11. Response Timing

Where Nevada’s consumer health data law applies, Trios will respond to an authenticated request without undue delay and generally no later than 45 days after authentication.

Where reasonably necessary because of the complexity or number of requests from the same consumer, the response period may be extended once by up to an additional 45 days where permitted by law, with notice of the extension and the reasons for it within the initial period.

Qualifying information requests will generally be provided without charge at least twice each year, subject to any legally permitted fee or refusal for manifestly unfounded, excessive, or repetitive requests.

12. Deletion Requests

For authenticated qualifying deletion requests under Nevada law, Trios will delete covered consumer health data from applicable records and systems within the period required by law and will notify applicable processors, contractors, affiliates, or other third parties that received the information of the deletion request.

Where Nevada law applies, Trios will generally complete the applicable deletion steps no later than 30 days after authenticating the deletion request. Recipients notified of the request must likewise comply within the period required by Nevada law.

Where covered data exists in archived or backup systems, Nevada law may permit deletion to be delayed for up to two years when necessary to restore those systems.

13. Appeals

If Trios refuses to act on a qualifying Nevada consumer health data request, you may appeal that decision by emailing:

Trios will review the appeal in accordance with Nevada law and provide a written response within the applicable period. If an appeal is denied, Trios will provide information about how to contact the Nevada Attorney General where required.

14. Sale of Consumer Health Data

Trios does not currently sell consumer health data.

If Trios were ever to propose a transaction legally considered a sale of consumer health data, Trios would first comply with Nevada’s applicable written-authorization, consent, and disclosure requirements.

15. Advertising

The public Trios website and Caregiver Weekly may in the future contain advertising, sponsored content, affiliate links, or commercial partnerships.

Advertisers do not receive access merely by advertising to:

  • Care Records;
  • medication information;
  • Daily Care Journal entries;
  • Mood, Energy, or Stress check-ins;
  • wellness scores;
  • care-recipient profiles;
  • private Care Circle information;
  • health-related Care Tasks.

Trios does not currently use private consumer health data to select or target advertisements.

16. Cross-Site Consumer Health Data Collection

Trios does not currently permit third-party advertising technologies to collect private consumer health data over time and across unrelated websites or online services through Trios.

If this practice materially changes, Trios will update this Notice and implement any legally required disclosure, consent, or authorization before beginning the new practice.

17. Geofencing

Trios does not currently use geofencing to identify or track individuals seeking health care, collect consumer health data at healthcare locations, or send health-related advertising based on visits to those locations.

18. Security

Trios uses administrative, technical, and organizational safeguards designed to protect consumer health data appropriate to its nature and sensitivity.

Access to consumer health data is intended to be limited to authorized persons and service providers where reasonably necessary to provide requested services or carry out permitted processing.

No information system can be guaranteed completely secure.

19. Material Changes to This Notice

If Trios materially changes how it collects, uses, processes, or shares consumer health data, Trios will provide notice to affected consumers through an appropriate method, which may include:

  • notice within the Trios application;
  • website notice;
  • account notice;
  • email;
  • another method appropriate to the nature of the change.

Where affirmative consent or authorization is legally required before the new practice begins, Trios will obtain it first.

20. Non-Discrimination

Trios will not discriminate against a consumer for exercising rights provided under applicable Nevada consumer health data law.

21. Relationship to Other Trios Privacy Notices

This Nevada Notice supplements the Trios Privacy Policy and the Trios Consumer Health Data Privacy Policy.

The General Privacy Policy addresses personal information more broadly.

The Consumer Health Data Privacy Policy addresses Trios’s overall consumer health data practices.

This Nevada Notice provides additional Nevada-specific information and rights.

If Nevada law grants a qualifying Nevada consumer a greater right regarding consumer health data, Trios will provide that right to the extent required by applicable law.
