Trios LLC (“Trios,” “we,” “us,” or “our”) respects your privacy and recognizes that caregiving may involve personal and sensitive information. This Privacy Policy explains how Trios collects, uses, discloses, retains, and protects personal information when you use the Trios website, mobile applications, any web-based Trios application made available by Trios, Caregiver Weekly, free and paid features, caregiver tools, support services, and related services (collectively, the “Services”).

Trios is designed to help caregivers organize care responsibilities while supporting caregiver wellbeing.

This Privacy Policy is our general privacy notice. Additional requirements apply to certain health-related information. Please also review our separate Consumer Health Data Privacy Policy at:

[trios-studio.com/consumer-health-data-privacy]

Certain Nevada residents may also receive additional information through our Nevada Consumer Health Data Notice.

1. Who Trios Is

Trios LLC is a Texas limited liability company that develops and operates the Trios caregiving platform and related public content.

For privacy questions or requests, contact:

Trios LLC Email: privacy@trios-studio.com

6. Sensitive and Health-Related Information

Some information users choose to place in Trios may reveal physical health, mental wellbeing, medication use, disability, symptoms, pain, sleep, caregiving needs, or similar sensitive information.

Where applicable law treats this information as sensitive personal data or consumer health data, additional requirements may apply.

Please review our separate Consumer Health Data Privacy Policy.

Trios does not currently use private sensitive caregiving or health information to target advertisements.

Trios does not currently sell consumer health data.

Where applicable law requires separate affirmative consent or authorization for the collection, use, sharing, or sale of consumer health data, acceptance of the Trios Terms of Use alone does not constitute that consent or authorization.

7. Caregiver Wellness Features

Trios may organize user-provided information into features such as:

  • wellness summaries;
  • support scores;
  • check-in history;
  • suggested self-care activities;
  • suggested next steps.

They are not medical diagnosis, treatment, professional medical advice, or emergency monitoring.

Trios does not currently use automated decision-making that produces legal or similarly significant effects concerning users.

8. How We Disclose Personal Information

We may disclose personal information in the following circumstances.

At Your Direction

Information may be provided to another person when you intentionally use a feature such as:

  • Care Circle sharing;
  • exports;

Service Providers

We use third-party service providers to operate and support Trios.

Google Workspace - Business email and communications.

We may also use providers supporting security, infrastructure, technical operations, or other functions necessary to provide the Services.

Service providers process information on our behalf or as otherwise described in their agreements and applicable privacy terms.

App Stores and Payment Platforms

When users purchase a Trios subscription through a mobile application, payment and billing functions may be provided by third-party platforms such as the Apple App Store or Google Play.

Those platforms may process payment credentials, billing information, and transaction information independently under their own privacy policies and terms.

Trios may exchange limited subscription or transaction information with those platforms as necessary to:

  • verify purchases;
  • activate or maintain paid features;
  • restore purchases;
  • determine subscription status;
  • process or recognize cancellations or refunds;
  • provide subscription-related support.

Trios does not receive access to a user’s full payment-card number merely because the user purchases a subscription through an app store.

Legal, Security, and Safety Purposes

We may disclose information when reasonably necessary to:

  • comply with applicable law;
  • respond to valid legal process;
  • comply with a court order or lawful governmental request;
  • enforce our agreements;
  • investigate fraud or misuse;
  • protect the security of the Services;
  • protect the rights or safety of Trios, our users, or others.

Business Transactions

If Trios is involved in a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar corporate transaction, personal information may be transferred as part of that transaction, subject to applicable law. To the extent a business transaction involves consumer health data, Trios will handle that information in accordance with applicable consumer health data laws and the Trios Consumer Health Data Privacy Policy.

9. Sale and Targeted Advertising

Trios does not currently sell personal information.

Trios does not currently sell consumer health data.

Trios does not currently share private personal information for cross-context behavioral advertising or targeted advertising.

The public Trios website and Caregiver Weekly may in the future contain:

  • advertisements;
  • sponsored content;
  • affiliate links;
  • caregiving-related product information;
  • commercial partnerships.

An advertiser’s purchase of advertising space will not give that advertiser access to private authenticated Trios information such as:

  • Care Records;
  • medication information;
  • Daily Care Journal entries;
  • wellness scores;
  • Mood/Energy/Stress check-ins;
  • care-recipient profiles;
  • private Care Circle information.

Information concerning a user’s subscription status or purchase history is not used to determine advertising based on the user’s private caregiving, health, or wellness information.

If Trios later introduces targeted-advertising technology or practices legally considered a sale or sharing of personal information, we will update our disclosures and implement legally required consent or opt-out mechanisms before beginning those practices.

10. Advertising and Sponsored Content

Paid advertising and sponsored content will be identified appropriately.

Trios may receive compensation for advertising, sponsorships, affiliate links, or commercial relationships.

Advertising or sponsored placement does not, by itself, mean that an advertiser receives access to private Trios account or care information.

If you click a third-party advertisement, affiliate link, sponsored link, or external product link, the destination service may collect information independently under its own privacy policy.

11. Cookies and Similar Technologies

Trios may use cookies, local storage, or similar technologies when necessary for:

  • authentication;
  • account sessions;
  • security;
  • preferences;
  • operation of the Services.

The public Trios website does not currently use third-party behavioral-advertising cookies or pixels.

If we introduce optional analytics, advertising technologies, or other tracking technologies, we will update our disclosures and provide consent or opt-out tools where required.

We may create aggregated or deidentified information that is not reasonably linkable to an identified or identifiable individual.

We may use such information to:

  • understand product usage;
  • improve Trios;
  • evaluate feature performance;
  • conduct internal analysis.

Where we maintain information as deidentified data, we will maintain it in deidentified form and will not attempt to reidentify it except as permitted by law for purposes such as testing whether deidentification measures are effective.

13. Data Retention

We retain personal information for as long as reasonably necessary to:

  • provide the Services;
  • maintain your account;
  • fulfill the purposes described in this Privacy Policy;
  • comply with applicable legal obligations;
  • resolve disputes;
  • maintain security;
  • enforce our agreements.

Retention periods may vary depending on the type of information and why it is processed.

When information is no longer reasonably necessary, we may delete or deidentify it, subject to applicable legal obligations and reasonable backup, disaster-recovery, security, or fraud-prevention practices.

Deletion from active systems may not immediately remove information from securely maintained backups.

14. Account and Data Deletion

How to request account and data deletion

Users may request deletion of their Trios account and associated personal information through available account functionality or by contacting:

privacy@trios-studio.com

We may retain limited information when required or permitted for:

  • legal compliance;
  • security;
  • fraud prevention;
  • dispute resolution;
  • enforcement of agreements;
  • backup integrity.

Consumer health data may be subject to additional deletion requirements described in the Consumer Health Data Privacy Policy.

Deleting a Trios account does not automatically cancel an active subscription managed through the Apple App Store or Google Play. Users must cancel recurring subscriptions through the applicable app-store account or other billing method through which the subscription was purchased.

15. Security

Trios uses administrative, technical, and organizational safeguards designed to protect personal information appropriate to the nature and sensitivity of the information processed.

However, no internet service, database, transmission system, or storage system can be guaranteed to be completely secure.

Users are responsible for protecting their account credentials and should notify Trios if they believe their account has been compromised.

If a security incident triggers notification obligations under applicable law, Trios will provide legally required notifications.

For health apps that fall outside HIPAA, the FTC Health Breach Notification Rule may independently require notice to affected consumers and regulators following certain breaches of unsecured identifiable health information.

16. Your Privacy Rights

Depending on where you live and which laws apply, you may have the right to:

  • confirm whether Trios processes personal information about you;
  • access personal information;
  • obtain a portable copy of certain information;
  • correct inaccuracies;
  • request deletion;
  • withdraw consent where processing depends on consent;
  • opt out of certain targeted advertising;
  • opt out of certain sales or sharing of personal information;
  • limit certain uses of sensitive information;
  • appeal certain decisions concerning privacy requests;
  • receive additional information concerning how your data is used or disclosed;

Not every privacy law applies to every company or every user. We provide rights required by the laws applicable to Trios and the individual request.

17. Exercising Your Privacy Rights

To submit a privacy request, email:

privacy@trios-studio.com

Emailing privacy@trios-studio.com initiates the request. For your security, do not include medications, diagnoses, Daily Care Journal content, or other sensitive health information in your initial email. Trios may direct you to an authenticated or otherwise secure process to verify your identity or authority and complete the request.

Instead, identify the type of request, such as:

  • Access Request
  • Correction Request
  • Deletion Request
  • Privacy Rights Request
  • Consumer Health Data Request

We may take reasonable steps to verify your identity and authority before acting on a request.

privacy@trios-studio.com

Use the subject line: Privacy Request Appeal

Include enough information for us to identify the prior request, but do not send unnecessary sensitive health information.

If an appeal is denied, we will provide information about additional complaint options where required by applicable law.

19. Children and Dependents

Trios accounts may only be created and maintained by individuals who are 18 years of age or older.

Adults may use Trios to organize care for children and other dependents where the adult is authorized to do so.

Information concerning a child or dependent may therefore appear within an adult caregiver’s account.

Trios is not directed to children, and individuals under 18 may not create or maintain Trios accounts. Trios does not knowingly collect personal information directly from children under 13 as account holders.

20. HIPAA and Other Health Privacy Laws

Trios is a consumer caregiving platform.

Whether the Health Insurance Portability and Accountability Act (“HIPAA”) applies to particular Trios activities depends on circumstances including whether Trios is acting for a HIPAA-covered healthcare provider, health plan, or business associate.

Trios does not represent that it is currently a HIPAA covered entity or business associate, and not all information stored or processed through Trios is necessarily subject to HIPAA.

If Trios enters into relationships requiring HIPAA compliance, business associate agreements, or additional controls, those requirements will be addressed before processing protected health information in that capacity.

Consumer health information may also be subject to other federal or state laws even where HIPAA does not apply.

Please also review our separate Consumer Health Data Privacy Policy.

If you access Trios from outside the United States, personal information may be processed in the United States and in other locations where our service providers operate.

Those jurisdictions may have data-protection laws different from those where you live.

Where applicable law requires a specific safeguard or transfer mechanism for international transfers, Trios will implement the legally required mechanism.

  • public resources;
  • advertisers;
  • affiliate partners;
  • product providers;
  • other third-party websites.

Trios does not control the privacy practices of those services.

When you leave Trios, the third party’s privacy policy and terms apply.

23. Changes to Our Services and Privacy Practices

Trios is expected to evolve.

Future functionality may include:

  • additional subscription plans;
  • payment options;
  • integrations;
  • healthcare-data connections;
  • analytics;
  • third-party services;
  • new caregiver tools;
  • additional advertising functionality.

Before using personal information for a materially different purpose, we will update applicable disclosures and obtain consent where required.

We will not silently begin using private sensitive caregiving information for materially unrelated advertising purposes.

24. Changes to This Privacy Policy

We may update this Privacy Policy as:

  • Trios develops;
  • our Services change;
  • our privacy practices change;
  • legal requirements change.

If changes are material, we will provide notice appropriate to the nature of the change, which may include notice through the website, application, account, or email.
